These Terms & Conditions ("T's & C's") govern your access to and use of the Zuccess (Pty) Ltd. website and all associated services, including but not limited to online courses, training materials, live workshops and community forums (collectively referred to as "the platform"). By accessing or using the platform, you agree to abide by these T's & C's. If you do not agree with any of these terms, please refrain from using the platform.

1. Acceptance of T's & C's 

By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by these T's & C's, as well as any additional terms and conditions provided by Zuccess (Pty) Ltd. You further agree to comply with all applicable laws and regulations.

2. Registration and Accounts

2.1. In order to access certain features of the platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Zuccess (Pty) Ltd. immediately of any unauthorized use of your account or any other breach of security.

3. Intellectual Property

3.1. All content and materials available on the platform, including but not limited to text, graphics, logos, images, audio clips, videos, software, and course materials, are the property of Zuccess (Pty) Ltd. or its licensors and are protected by copyright and other intellectual property laws.

3.2. You may not modify, reproduce, distribute, transmit, display, perform, or create derivative works of any content from the platform without the prior written consent of Zuccess (Pty) Ltd. You agree to abide by all copyright notices, trademarks, and other proprietary rights contained in the content.

4. Use of the Platform

4.1. You agree to use the platform only for lawful purposes and in accordance with these T's & C's. You agree not to use the platform in any manner that could damage, disable, overburden, or impair the platform, or interfere with any other party's use and enjoyment of the platform.

4.2. You agree not to engage in any conduct that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, obscene, invasive of another's privacy, or otherwise objectionable.

5. User Content

5.1. The platform may allow you to submit or post content, including but not limited to comments, questions, feedback, and other materials (collectively referred to as "User Content"). By submitting or posting User Content on the platform, you grant Zuccess (Pty) Ltd. a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any form, media, or technology now known or hereafter developed.

5.2. You represent and warrant that you have all necessary rights to grant the foregoing licenses and permissions with respect to the User Content.

5.3. You agree not to submit or post any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, obscene, invasive of another's privacy, or otherwise objectionable.

6. Disclaimer of Warranties

6.1. Zuccess (Pty) Ltd. makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of any content or materials available on the platform.

6.2. Zuccess (Pty) Ltd. disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Zuccess (Pty) Ltd. does not warrant that the platform will be uninterrupted or error-free, or that any defects will be corrected.

7. Limitation of Liability

7.1. In no event shall Zuccess (Pty) Ltd. be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or inability to use the platform, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if Zuccess (Pty) Ltd. has been advised of the possibility of such damages.

7.2. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Zuccess (Pty) Ltd. has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Zuccess (Pty) Ltd., its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or in connection with your use of the platform, your violation of these T's & C's, or your violation of any rights of another party.

9. Governing Law and Jurisdiction

These T's & C's shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. Any dispute arising out of or in connection with these T's & C's shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

10. Changes to T's & C's

Zuccess (Pty) Ltd. reserves the right to modify or revise these T's & C's at any time without prior notice. Your continued use of the platform after any such changes shall constitute your acceptance of the modified T's & C's.
